           10                 A     Yes,  I  think  if  there  was  any  water  of any  quantity

           11     eoming  out  of  that  dam,  it weuld  be  on  the  surtaeo.

           12                 Q.    Do  you kn-ow  if  the  flow  had  i:nerease4  some  two  weeks

          13      before  the  break1I1€  of  the  dam?

          14                  A     No,  I  don't.

          15                  Q     No  check  was  being made  on  that?

          16                  A.    Of  eourse,  and  if there  was  any  inerease  in  the  Santa

          17      Clara  River,  there  would  be  no  connection  between  that  and  ours.

          18                  ~  Do  you know  if  there  was  any  in the  St.  F'.ranoia              1   or

          19      any  under  surface  flow?

          20                  A     No,  only  that  was  accountable  for.

          21                  Q     I  understand  water  doesn't  exert  an  equal »reeaure  in

          23                  A     Yes,  it does.

          24                  Q.    Laterally  e.s  well  as  vertical pressure?

          25                  A     Yes,  any  given  depth  in water,  the  pressure  would  be

          26      the  same.

          27                  Q     Assuming  that  the  formation  beneath the  bedrock  there

          28      had  become  softened and  weakened  b;y  slow  gradual  percolation or

          29      saturation of  the  water  :from  the  dam.  and  that  the formation  was

          30      such  as  to  permit  it to  suddenly  give  way,  that would  have  in-
